====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks regular bail in connection with Daraundha P.S. Case No. 84 of 2018, registered for offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he assaulted the son of the informant by knife and when the informant came to save his son, he assaulted with knife by the petitioner. Later on, when daughters of the informant came and try to save her father and brother, they also given knife blow in her stomach causing grievous injury.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and there is a land dispute between the parties and the petitioner is in judicial
Patna High Court Cr.Misc. No.65306 of 2018(3) dt.05-12-2018 2/2 custody since 11.06.2018.
Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner on the ground that the injured persons have supported the prosecution case and the injuries of the son and daughters of the informant are found to be grievous in nature. Having heard both sides, in view of the above facts, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
