Petitioner, who is in custody, seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is recovery of 28.32 liters of foreign liquor from the back side of the shop of the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from his conscious possession. Petitioner is in custody since 25.10.2019.

Patna High Court CR. MISC. No.85406 of 2019(2) dt.07-01-2020 2/2 Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is hereby rejected.

However, after completing six months of the custody, the petitioner would be at liberty to renew his prayer for grant of bail.
