Petitioner apprehends his arrest in Khaira P.S. Case No.13 of 2014 instituted for the offence under Section(s) 302/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Jamui.
In the instant case, a report was called for from the Court below about the current stage of the case with regard to the petitioner. The Court below has submitted in the report dated 14th May, 2018, that processes under Section 83 Cr. P.C. has already been issued against the petitioner on 05.04.2015 and the petitioner is evading appearance before the Court. In the written report, there is allegation against the
Patna High Court Cr.Misc. No.16851 of 2018 (5) dt.19-06-2018 2/2 petitioner that he along with other accused persons brutally assaulted the son of the informant on head on account of which he died.
In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner is directed to surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order.
