2. The petitioner apprehends his arrest in a case registered for offence under Sections 406, 420, 504, 467, 468, 471/34 of the Indian Penal Code.
3. It is alleged that this petitioner and other accused persons cheated Rs. 39,00,000/- (Thirty nine lacs) from the informant in lieu of giving profit of 30% of investment in business of medicine and other electronic goods in the different medical college, since he got the tender for supply in the medical college.
4. Learned counsel for the petitioner submits that entire allegation is false and concocted. As a matter of fact, the alleged amount has been credited in the account of co-accused
Patna High Court CR. MISC. No.1586 of 2025(2) dt.11-02-2025 2/2 Najmus Shaqib, who is neither employee nor partner of petitioner. He further submits that in fact, petitioner filed a complaint case, vide Complaint Case No. 1152 of 2023 against one Md. Faiz Ahmad and some other persons, in which informant is also an accused, and only after coming to know about the aforesaid complaint case, in retaliation, the informant filed the present case.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation against this petitioner that he alongwith others cheated Rs. 39 lacs of informant. Besides this, petitioner has also got three criminal antecedent.
6. Considering the nature of accusation and criminal antecedent, the prayer for anticipatory bail of petitioner is rejected.
