JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 The petitioner is apprehending his arrest in connection with POCSO Case No. 8/2018 arising out of Sasaram (T) P.S. Case No. 229/2018, registered for offences punishable under Sections 376(D), 120(B) of the Indian Penal Code and Section 4 and 6 of the POCSO Act.

Allegation against the petitioner that he along wither other accused persons committed rape with the informant. It has been submitted on behalf of the petitioner that the petitioner has falsely been made accused in this case and although she has named the petitioner in written report but she has not named him in her statement under Section 164 Cr.P.C. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.25341 of 2018 (3) dt.22-06-2018 2/2 circumstances of the case and the nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.
