Petitioner apprehends his arrest in connection with Koilwar P.S. Case No. 132 of 2014, registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Allegation against the petitioner is of causing death of the deceased and the case appears to be of the year 2014. Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and two other co-accused having similar allegation have been granted privilege of anticipatory bail vide order dated 10.2.2015 passed in Cr.Misc.No.5361 of 2015 and vide order dated 29.6.2015 passed in Cr.Misc.No. 49753 of 2014 (Annexure-2 Series).

Patna High Court Cr.Misc. No.27293 of 2018 (3) dt.10-05-2018 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that petitioner is named in the FIR and he was absconding since long.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and pray for regular bail, which shall be considered on the basis of materials available on record and also the fact that earlier other co-accused had been granted privilege of anticipatory bail by this Court. With the above observation, this application is disposed of.
