Petitioner apprehends his arrest in a case registered under Section 366(A) of the Indian Penal Code. Informant who is the grandmother of the victim has alleged in her written complaint that on 10.08.2019 her granddaughter Komal Kumari aged 14 years alongwith other family members were sleeping and on 11.08.2019 at 3:00 AM when she woke up she did not find her granddaughter Komal Kumari and subsequently she came to know that petitioner who is her neighbour has enticed away her granddaughter for purpose of marriage. The girl in her statement under Section 164 Cr.P.C. before the Magistrate has stated that informant was

No.82935 of 2019(2) dt.13-12-2019 2/2 planning to marry her with a 50 year old man against her wish, as such, she voluntarily and on her own sweet will went away with the petitioner and thereafter they have solemnized marriage and herself returned back and has disclosed her date of birth as 25.08.2000.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Digha P.S. Case No. 465 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) veena/- U T
