The petitioner is apprehending his arrest in connection with Complaint Case No.1320 of 2014 registered for offences punishable under Sections 406, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of taking friendly loan of Rs.03 lac from the complainant and a cheque was issued by the petitioner, which was dishonoured.

Submission of the learned counsel for the petitioner is that he is ready to deposit the amount if some reasonable time given to the petitioner.

Patna High Court Cr.Misc. No.36613 of 2018 (3) dt.20-08-2018 2/2 Heard learned A.P.P. and the learned counsel for the complainant.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender within a period of six weeks from the date of receipt of the order along with a bank draft of Rs.01 lac payable in the name of O.P.no.2 and once the aforesaid amount is deposited, the petitioner shall be released on provisional bail for a period of two months and if the rest of the amount Rs.02 lac is deposited within two months, payable in the name of O.P.no.2, which shall be subject to result of the case, the bail bond of the petitioner shall be confirmed.

With the aforesaid observation, this application is disposed of.
