2. The petitioner seeks regular bail in connection with Katihar (N) P.S. Case No. 837 of 2023 registered for the offence under Sections 302, 120(B), 34 of the Indian Penal Code and Section 25(1-B)a, 26, 27, 35 of the Arms Act.

3. As per the prosecution case, the petitioner and others are said to have killed the deceased. The deceased has disclosed the name of the petitioner to his wife.

4. Learned senior counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 23.11.2023 and he has criminal antecedents also.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. In the trial out of ten witnesses, six witnesses have already been examined.

7. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.

8. Accordingly, this application for regular bail is hereby rejected.
