ANJANA MISHRA ORAL ORDER 09-01-2020 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 26.07.2019 in connection with Barauni [Refinery] P.S. Case No.317 of 2019, G.R. No.2696 of 2019 registered for the offence under Sections 420, 379, 411, 120B and 34 of the Indian Penal Code and Section 7 of the Essential Commodities Act. The petitioners seek to renew their prayer for bail, which was earlier rejected vide order dated 05.09.2019 in Cr.Misc. No.54929 of 2019.

Patna High Court CR. MISC. No.82907 of 2019(2) dt.09-01-2020 2/2 appearing on behalf of the petitioners submits that the provisions of Section 7 of the E.C. Act will not apply in the present case. So far as Section 379 of the I.P.C. is concerned, the petitioners have been in custody for almost six months and are having no criminal antecedents, therefore, may be extended the privilege of bail.

Considering the aforementioned facts and circumstances of the case, let all the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Begusarai, in connection with Barauni [Refinery] P.S.
