JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Chautham P.S. Case No. 216 of 2019, dated 18.09.2019, instituted for the offences under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears that though the petitioner has been named in the F.I.R. and there was suspicion of the police party that he along with others had brought in huge quantity of liquor to be sold to public at large, but raid was conducted only in the field of a named accused person, viz., Rajesh Singh @ Dibba. From the field of the aforesaid co-accused

Nothing has been recovered either from the constructive or personal possession of the petitioner. It has further been submitted that the petitioner has clean antecedents and thus, his implication in the present case is only on the basis of suspicion that he too is indulging in sale and purchase of liquor.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-II-Cum-Special Judge, Khagaria in connection with Chautham P.S. Case No. 216 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
