====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Spl. Case No. 38 of 2019 arising out of Vigilance P.S. Case No. 38 of 2019 registered under section 7(a) of the P.C. Actpending in the Court of Special Vigilance-I, Patna.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case only to put pressure. Further submission is that petitioner is in custody since 21.09.2019.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that the petitioner was caught red-handed on the spot while

Patna High Court CR. MISC. No.83390 of 2019(2) dt.20-01-2020 2/2 taking bribe and accordingly, the Post Trap Memo was prepared. Hence, this is not a fit case for bail.

Having considered the above facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
