The petitioner seeks bail in connection with Ishipur (Barahat) P.S. Case No.32 of 2019 registered under Sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that save and except confessional statement of a co-accused, which is not admissible in evidence, there is no material to connect the petitioner with the offence alleged. He has further contended that though the petitioner is in custody for almost eight months, the police have not put him on test identification parade.

Learned counsel for the State has opposed the

Patna High Court CR. MISC. No.83772 of 2019(3) dt.17-03-2020 2/2 prayer for grant of bail to the petitioner on the ground that the petitioner has got criminal antecedent and his name transpired in the disclosure made by a co-accused.

Regard being had to the submissions advanced at the bar, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-VIII, Bhagalpur in connection with Ishipur (Barahat) P.S. Case No.32 of 2019.
