The petitioner seeks regular bail in connection with Barhara Case No. 112 of 2019, registered for the offence punishable under Sections 302, 307, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding unknown miscreants having made indiscriminate firing resulting in one person dying on the spot.

The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and he has been named in the confessional statement made by the co-accused person, namely, Santosh Kumar, who is stated to have been granted the privilege of bail by a coordinate Bench of this Court vide

Patna High Court CR. MISC. No.82529 of 2019(2) dt.16-12-2019 2/2 order dated 23.10.2019 passed in Criminal Miscellaneous No. 57444 of 2019. It is further submitted that charge-sheet has already been filed in the present case and as far as the petitioner is concerned, he is having a clean antecedent. The petitioner is stated to be languishing in custody since 1.9.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Fast Track Court No. 1 Purnea in connection with Barhara P.S.
