JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Sanjhauli P.S. Case No. 128 of 2019, dated 02.09.2019, instituted for the offences under Sections 137, 148, 149, 323, 324, 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act. It has been alleged in the F.I.R. that about 50 - 60 persons variously armed with weapons including the petitioner came to the house of the informant and resorted

Patna High Court CR. MISC. No.82410 of 2019(2) dt.12-12-2019 2/3 to firing. The inmates of the house were also assaulted. The car parked in front of the house of the informant was also damaged.

It has been submitted on behalf of the petitioner that an absolutely false case has been lodged by the informant for avenging a different enmity with some of the accused persons of this case. The accusation against the petitioner is absolutely general and omnibus and he has not specifically been attributed to have done anything. One of the accused persons of this case, viz., Vijay Kumar has also lodged a case vide Sanjhauli P.S. Case No. 127 of 2019 against the informant and others which was earlier in point of time, but because of the collusion of the police, the case filed by the informant of the present case was lodged earlier. The injuries suffered by the victims are stated to be simple in nature caused by hard and blunt substance. It also appears to be rather improbable that several persons are alleged to have fired, but there is no firearm injury on any person.

Considering the aforesaid facts and taking into

No.82410 of 2019(2) dt.12-12-2019 3/3 account that the petitioner does not have any criminal antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of four week, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Sanjhauli P.S. Case No. 128 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
