The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 252 of 2019 for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2018. The allegation is regarding recovery of 864 liters of illicit liquor while the same was being unloaded in front of the door of the house of the petitioner from a bolero vehicle. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent, no recovery has been made from the house of the petitioner and the petitioner has got no connection either
Patna High Court CR. MISC. No.85103 of 2019(2) dt.20-12-2019 2/2 with the bolero vehicle or with the illicit liquor and he is languishing in custody since 14.10.2019.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Excise Court, Vaishali at Hajipur in connection with Jandaha P.S.
