====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Bakhtyarpur P. S. Case No. 137/2024 in a case registered for the offences punishable under Sections 8(B), 8(C), 18, 29, 46 of the Narcotic Drugs and Psychotropic Substances Act.

3. This petitioner is alleged to be involved in cultivation of opium and 20 opium plants were recovered from possession of the accused persons including petitioner.

4. Learned counsel for the petitioner submits that petitioner has got no concern with the alleged recovery. Petitioner has been made accused only on suspicion. It is further submitted that similarly situated co-accused, namely, Bipin Prasad has already been granted bail by co-ordinate Bench of

Patna High Court CR. MISC. No.8406 of 2025(4) dt.09-05-2025 2/2 this Hon'ble Court vide order dated 25.03.2025 passed in Cr. Misc. No. 80202 of 2024. Petitioner claims clean antecedent. Petitioner is in custody since 19.06.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, Patna in connection with Bakhtyarpur P. S. Case No. 137/2024.
