The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420, 409, 467, 468, 471 and 34 of the Indian Penal Code. The petitioner in association with the then Circle Officer and revenue karamchari is said to have made manipulations in the revenue records.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. It is also submitted that Jamabandi has been created for land in question in the year 1979-80 vide Jamabandi No.3223 in the name of the concerned school and at that time the petitioner was not posted in

Patna High Court CR. MISC. No.87486 of 2019(4) dt.19-02-2020 2/2 Lakhanour Anchal. The 1st rent receipt has been issued regarding the land in question in the year 1979-80, 2nd rent receipt in the year 1989-90 and 4th rent receipt has been issued in the year 2017-18 and not even a single rent receipt has been issued by the petitioner and thus no case of forgery or defalcation is made out against him. Petitioner is a retired government employee and has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani in connection with Lakhanaur (R.S. O.P.) P.S. Case No.237 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
