The petitioner seeks bail in connection with Khagaria Rail P.S. Case No.18 of 2017 registered under Sections 302, 201/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that save and except wild suspicion and remote circumstantial evidence, there is no material to connect the petitioner with the offence alleged. He has further contended that co-accused Md. Haidar @ Md. Haidar Ali, Md. Sarfuddin @ Md. Ujulwa and Md. Maqbool @ Masroor @Maqbool Alam @ Md. Masroor whose case stands on similar footing to that of the petitioner have already been granted bail by a co-ordinate Bench of this

Patna High Court CR. MISC. No.83779 of 2019(4) dt.17-03-2020 2/2 Court vide order dated 22.01.2020 passed in Cr. Misc. No.3359 of 2019. Another co-accused Bipin Chaudhary @ Bipin Choudhary has been granted bail by a co-ordinate Bench of this Court vide order dated 17.02.2020 passed in Cr. Misc. No. 9527 of 2020. Similarly, co-accused Md. Vadil and Md. Sadir @ Md. Sabir @ Sabir have also been granted bail by a co-ordinate Bench of this Court vide order dated 21.01.2020 passed in Cr. Misc. No.167 of 2020.

Learned counsel for the State does not dispute the aforesaid contention advanced on behalf of the petitioner. In that view of the matter, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Railway Khagaria in connection with Khagaria Rail P.S. Case No.18 of 2017 .
