1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the O.P. No. 2

2. The learned counsel appearing on behalf of the opposite party no.2 submits that the case was taken up on 05.02.2026 when petitioner was released on provisional regular bail on furnishing bail bonds of Rs. 25,000/- and notices were issued on O.P. No. 2. It is next submitted that thereafter the case was taken up on 18.03.2026, further on 20.04.2026 wherein a detailed order was recorded and a submission was made by the learned counsel appearing on behalf of the petitioner that he has instructions to make submission that petitioner has 40 katthas of

Beldaur, DistrictKhagaria, further petitioner is not in a position to pay the amount of maintenance of Rs. 6,000/- as directed by order dated 29.08.2017 in Maintenance Case No. 64(M) of 2017 by the learned Family Court, it was also submitted that petitioner, out of 40 Katthas of land, shall register 10 Katthas of land jointly in the name of O.P. No. 2 and his daughter Neha Kumari, so that the ordeal of O.P. No. 2 and the daughter comes to an end.

3. Further, the case was again taken up on 15.05.2026, when a submission was made by the learned counsel appearing on behalf of the petitioner that he will try to to clear the arrear of maintenance as directed by the learned Family Court.

4. The learned counsel appearing on behalf of the O.P. No. 2 submits that petitioner, after being released on provisional regular bail, is only buying time. It is also submitted that petitioner has performed his second marriage and out of the said wedlock, two children were born and the petitioner is enjoying life with his second wife and children, but then has neglected the O.P. No. 2 and his daughter who is staying with the O.P. No.

2. It is further submitted that conduct of the petitioner has caused immense mental trauma to the O.P. No. 2. It is also submitted that one can well imagine the plight of O.P. No. 2

It is further submitted that though petitioner was released on provisional regular bail and had assured this Court that out of 40 Katthas of land 10 Katthas of land shall be registered in the name of the O.P. No. 2 and his daughter, but then the same till date has not been done, which amply reflects the conduct of the petitioner. It is also submitted that even marriage of the petitioner with his second wife is a void marriage.

5. The learned counsel appearing on behalf of the petitioner is not in a position to rebut the submission of the learned counsel appearing on behalf of the O.P. No. 2.

6. After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail, as such, the provisional regular bail granted to the petitioner by order dated 05.02.2026 is hereby recalled.
