Mr. Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2019 Petitioner seeks regular bail in connection with Mehsi P. S. Case No. 218 of 2018 registered for the offence punishable under Section 395 of the Indian Penal Code.

As per F.I.R. there was a Dacoity in the house of the informant, several articles were looted. F.I.R. is against unknown. It appears that name of the petitioner transpired in confessional statement of the co-accused. Apart from that he is accused in one more case of similar type.

Submission of the learned counsel for the petitioner is that he is in custody for more than two months. Except confessional statement, there is nothing against him. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, at this stage, I am not inclined to

Patna High Court CR. MISC. No.82926 of 2019(2) dt.13-12-2019 2/2 grant bail to the petitioner. However, once the charge has been framed or petitioner remains in custody for six months, whichever is earlier, he is at liberty to renew his prayer for bail. With the above observations, this application is dismissed.
