This application for anticipatory bail arises out of Koilwar P.S. Case No. 236 of 2019, disclosing the offence under Sections 341, 323, 324, 325, 308, 504, 506, 34 of the Indian Penal Code.

I find substance in submission made on behalf of the petitioner that a dispute in respect of ownership over a piece of land had given rise to the present occurrence. For the occurrence said to have taken place on 18.07.2019, case and counter-case have been registered making allegations against each other of assault because of the dispute over the land in question. Learned counsel appearing on behalf of the petitioner has submitted that the persons named in the present FIR and the

Patna High Court CR. MISC. No.82756 of 2019(3) dt.23-06-2020 2/2 counter-case i.e. Koilwar P.S. Case No. 248 of 2019 are agnates. Considering the genesis of occurrence and nature of accusation, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., Bhojpur at Ara in Koilwar P.S. Case No. 236 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
