In this case, the petitioner is seeking relief that he should be given the benefit of pay scale as per 5th and 6th Pay Revision Commission report as others similarly situated persons have been granted the said benefit, but the petitioner has been deprived of the same.
This Court is not entering into the merits of the case. If the other similarly situated persons have been granted the benefit of pay scale as per 5th and 6th Pay Revision
Patna High Court CWJC No.14826 of 2018(2) dt.07-09-2018 2/2 Commission report, then this Court fails to understand why there will be deprivation. Hence, this Court directs the respondents to examine the claim of the petitioner and if it is found that other similar situated persons have been granted the benefit of pay scale as per 5th and 6th Pay Revision Commission report, in such circumstance, the petitioner will also be given the same benefit. The entire exercise should be completed by the respondents within a period of six (6) months from the date of receipt/production of a copy of this order.
With the aforesaid observations and directions, this writ petition is disposed of.
