The petitioner is in custody since 21.07.2019 in connection with Bihiya P.S. Case No. 275 of 2019 for the offence under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. It is alleged that from the possession of the petitioner, one country made pistol with four live cartridges has been recovered.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 21.07.2019.

Considering the fact that the petitioner has no criminal antecedent and he is in custody for more than three months, let

Case No. 275 of 2019.
