====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-02-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 126(2), 115(2), 109, 352, 351(2)(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, when the informant demanded Rs.100/- from petitioner no.1, which was earlier given to him, petitioner no.1 refused to return the same. Thereafter, all the accused persons including these petitioners assaulted informant and his brother with lathi, danda and
Patna High Court CR. MISC. No.2686 of 2025(2) dt.15-02-2025 2/2 iron rod as a result of which informant and his brother sustained head injuries.
4. It is submitted on behalf of the petitioners that the parties are co-villagers and due to petty dispute altercation took place between the parties. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners. Petitioners claim clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bhojpur at Ara in Azimabad Police Station Case No. 81/2024, subject to the conditions laid down under section 482 the Bharatiya Nagarik Suraksha Sanhita, 2023.
