2. Petitioner seeks regular bail in connection with Kutumba P.S. Case No. 46/ 2025 dated 15.03.2025 registered for the offence(s) punishable under Sections 108 and 3(5) of the BNS.

The main submissions advanced by the petitioner's counsel are that the deceased, who was the daughter-in-law of the petitioner, committed suicide after spending 12 years of her marriage with the son of this petitioner as well as after having begotten three children, as a matter of fact, the deceased along with her children was residing in Delhi and about one week prior to the occurrence she returned back to her matrimonial home whrere on account of some dispute with her husband, she consumed poison and subsequently died. It is further submitted

No.89000 of 2025(2) dt.12-01-2026 2/2 that petitioner, who is 57 years old person, has been languishing in jail since 15.10.2025 and he himself surrendered before the trial court and the deceased's husband is already in jail and against him, the investigation has been completed.

4. The learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the aforesaid submissions advanced by the petitioner's counsel, averments made in this petition, the petitioner's custody period and completion of investigation against him coupled with the cause of the death of the deceased, which took place after about 12 years of her marriage and as per prosecution, she committed suicide, in my opinion, it is a fit case for grant of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Kutumba P.S. Case No. 46/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
