2. The petitioner is apprehending his arrest in connection with Kishanganj P.S. Case No. 308 of 2024, F.I.R. dated 14.08.2024 for the offences punishable under Sections 376 and 384 of the Indian Penal Code.

3. According to prosecution case, the informant alleged that the petitioner is involved in human trafficking and enticed her and raped her and also threatened to make her obscene video viral if she took any step against him.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in

Patna High Court CR. MISC. No.1184 of 2025(4) dt.18-06-2025 2/2 the F.I.R./complaint petition is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R/complaint petition.

5. The learned Additional Public Prosecutor on the basis of materials available on record has vehemently opposed the prayer for bail of the petitioner and submits that the victim, in her statement recorded under Section 164 of Cr.P.C/183 of BNSS has categorically stated that the petitioner committed rape upon her in the hotel at Purnea and apart from that due to the present occurrence the victim has tried to commit suicide. He further submits that petitioner carries one criminal antecedent other than the present one.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Kishanganj P.S. Case No. 308 of 2024 pending in the court of Chief Judicial Magistrate, Kishanganj.

7. Prayer is refused.
