Petitioner, already in custody since 6.1.2018, seeks bail in DRI Case No. 1 of 2018/419 of 2018 registered under Sections 135(1)(b) of the Customs Act.

The allegation in brief is that the petitioner was found in possession of 5 Kilogram 100 grams of gold bar worth Rs. 1,55,55,000/- being smuggled from Bangladesh and he was apprehended in the running train.

Learned Counsel for the petitioner submits that the petitioner has been in custody in this case since 6.1.2018, charge has also been framed and the petitioner is a jewelry shop owner. Learned Counsel appearing on behalf of Union of India submits that there has been recovery of gold bar worth Rs. 1,55,55,000/- and charge too has been framed. Having considered the said facts and circumstances, the prayer for bail of the petitioner is presently rejected. However if the trial does not conclude within three months the petitioner may renew his prayer for bail.
