The petitioner is in custody in connection with Chitragupta Nagar P.S. Case No. 717 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that earlier the petitioner was made accused, but not for the offence of Bihar Prohibition and Excise Act. The petitioner is in custody since 15.10.2019. He further submits that nothing was recovered from the conscious possession of the petitioner and his name was disclosed by the Chaukidar of the village with whom the petitioner has inimical terms.

Considering the fact that nothing was recovered from the possession of the petitioner and also the fact that the
