JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-09-2020 Sri Anil Prasad Singh, learned counsel for the petitioner and Ms. Anita Kumari learned A.P.P. for the State are present to argue this case through video conferencing, but Sri Ranjit Kumar Singh, learned counsel for O.P. No. 2 is not present today, while link has already been sent to him. The petitioner apprehends his arrest in connection with Complaint Case no. 2828(C) of 2017, for the offence under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner and O.P. No.2 are husband and wife and their matrimonial dispute has already been settled out of Court by
Patna High Court CR. MISC. No.81992 of 2019(6) dt.11-09-2020 2/2 the efforts of the respected people of the society. A compromise petition in that regard has also been filed on 17.06.2020 in the Court of S.D.J.M. Araria.
Having regard to the facts and circumstances of the case and also the fact that the dispute between the petitioner and O.P. No.2 has already been resolved by the intervention of the punches, let the petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Araria in connection with Complaint Case no. 2828(C) of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
