The petitioner apprehends his arrest in Sanjhauli P.S. Case No.126 of 2019, registered under Sections 147, 149, 323, 379 and 427 of the Indian Penal Code.

The informant alleged that at about 8.40 P.M., the accused persons came in front of his medical agency on three motorcycles and entered into the shop. They assaulted the informant and broke different articles of the shop. The accused persons including the petitioner are alleged to have taken out Rs.21,000/- from the cash box.

Learned counsel for the petitioner submits that in fact no occurrence, as alleged by the informant, has ever taken place. The petitioner lodged Sanjhauli P.S. Case No.127 of 2019 for the offences allegedly committed under Sections 147, 149, 279,

Patna High Court CR. MISC. No.85022 of 2019(3) dt.26-06-2020 2/2 337, 379 and 504 of the Indian Penal Code against the informant, Ritik Raushan and his family members. It is alleged that Ritik Raushan, the informant of the present case, dashed the petitioner, Vijay Kumar with his motorcycle and for that some altercation took place.

Taking into considering the facts aforesaid and the fact that there is case and counter case between the two sides and omnibus and general allegation of assault and snatching of money is made, let petitioner, namely, Vijay Kumar @ Vijay Bharat in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vikramganj, Rohtas in connection with Sanjhauli P.S.
