SONI SHRIVASTAVA ORAL ORDER 11-08-2025 Heard learned counsel for the petitioner and learned APP for the State. No one appears on behalf of the Opposite Party No. 2, despite issuance of notice.

2. The petitioner apprehends his arrest in connection with Jamalpur P.S. Case No. 142 of 2019, registered for the offences punishable under Sections 498A, 341, 323, 379, 504 and 34 of the Indian Penal Code.

3. The allegation in the F.I.R. is with regard to demand of dowry and torture.

The learned counsel appearing on behalf of the petitioner submits that the allegations made in the F.I.R. are not correct and earlier also the Opposite Party No. 2 had filed a complaint case under the same sections which is Annexure P2 to the application besides another domestic violence case filed in the year 2017. As a matter of fact, the informant had been putting pressure upon the petitioner for seeking a partition in the

Patna High Court CR. MISC. No.2515 of 2025(6) dt.11-08-2025 2/2 ancestor's properties and on not agreeing to the same, the present case has been instituted. It has also been stated in paragraph 14 of the bail petition that the petitioner is ready to keep his wife/informant with full dignity and honour. Further, the petitioner is posted in the police force in the State of Jharkhand.

Considering the facts and circumstances and also considering the fact that the petitioner has showed his willingness to keep his wife with full dignity and honour despite the fact that this is the second case filled under Section 498A against the petitioner and further, there is no chance of his absconding, as he is a Government servant, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Jamalpur P.S. Case No. 142 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of the B.N.S.S., 2023 and further subject to the following condition that the petitioner shall co-operate in the investigation/trial.
