This application for anticipatory bail arises out of Kotwali P.S. Case No. 983 of 2019, disclosing the offence under Sections 341, 342, 448, 354, 354-A, 354-B, 506 of the Indian Penal Code and Sections 6, 8 of the POCSO Act. From the First Information Report and the statement of the victim recorded under Section 164 of the Cr.P.C. it transpires that there is allegation against the petitioner of having made attempt to outrage the modesty of the victim. Learned counsel appearing on behalf of the petitioner has submitted that there are contradictory statements in the FIR and that of statement under Section 164 of the Cr.P.C. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J.-1st cum Special Court POCSO, Patna in Kotwali P.S. Case No. 983 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
