The petitioner seeks bail in a case registered under Sections 323, 307, 379, 504, 506 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of firing on the informant's elder brother causing injury to him. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.10.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. Free fight is alleged to have taken place. The petitioner is said to have caused injury on nonvital part of the body. Hence, no offence under Section 307 of

Patna High Court CR. MISC. No.83224 of 2019(2) dt.16-12-2019 2/2 the I.P.C. is made out. An application has been filed before the court below vide Annexure 4 to the present application, where the informant has retracted from the earlier statement made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. case No.01 of 2019.
