The petitioner who is in custody since 14.10.2019 has filed the instant application for grant of bail in connection with Manjhagarh P.S. Case No. 259 of 2019 (G.R. No.1234 of 2019) (District-Gopalganj) registered for the offence punishable under sections 30(a),41 and 45 of the Indian Penal Code. As per the allegation in the FIR, on search of the tractor being conducted by the police, 349.02 litres of country liquor is stated to have been recovered from which three accused persons are said to have escaped. It is further stated in the F.I.R. that on enquiry being made, secret information was received that amongst the three persons who had escaped, one was the petitioner.

No.81750 of 2019(2) dt.11-12-2019 2/2 It is submitted by learned counsel for the petitioner that the allegation against the petitioner of being amongst the aforesaid three accused persons is false and concocted. The petitioner has neither any concern with the said tractor nor with the consignment loaded on the same. The petitioner is in custody since 14.10.2019 and has no criminal antecedent. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge (Excise) Gopalganj in connection with Manjhagarh P.S. Case No. 259 of 2019 (G.R. No.1234 of 2019)(District-Gopalganj). (Partha Sarthy, J) Bibhash/- U T
