The petitioner is languishing in custody for the offences punishable under Sections 302/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Unknown miscreants allegedly caused murder of an under-trial prisoner Babloo Dubey, who had also having notorious antecedent, while he was being produced in Court. Some other co-accused have been allowed bail by a coordinate Benches of this Court. The petitioner was identified during Test Identification Parade. The report of the Court-below would reveal that the trial has not started as yet. The petitioner was identified during Test Identification Parade by

Considering the facts aforesaid especially grant of bail to some other co-accused, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bettiah Town P.S. Case No.337 of 2017, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
