2. This is the second attempt of the petitioner for grant of regular bail in connection with Patepur P.S. Case No. 241 of 2023 registered for the offence under Section 392 of the Indian Penal Code.
3. As per the prosecution case, unknown criminals looted one motorcycle and mobile from the informant.
4. Learned counsel for the petitioner submits that petitioner will give an undertaking in the Court below that he will not involve himself in any criminal case after being released on bail. The petitioner is in jail since 10.11.2023 and no T.I. parade has been held. He also submits that petitioner will not stay in the State of Bihar. He will stay at his co-villager's
Patna High Court CR. MISC. No.1870 of 2025(2) dt.05-02-2025 2/3 house in Chattisgarh.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur/concerned Court below in connection with Patepur P.S. Case No. 241 of 2023.
8. As a condition of this order, the petitioner shall appear in the trial regularly either virtually or through his lawyer and shall cooperate in the trial.
9. The petitioner after grant of bail will stay at the following address- "C/o Binay Kumar Ray, Pipra New Bus Stand, P.O.- Pipra Sabji Mandi, P.S.- Sirgitti, Bilaspur, Chhattisgarh."
10. The petitioner will mark his attendance at the Sirgitti Police Station, Bilaspur, Chhattisgarh on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
11. The petitioner will visit Bihar only on the date
Patna High Court CR. MISC. No.1870 of 2025(2) dt.05-02-2025 3/3 fixed in the present case as well as in other cases in which he is an accused and is required to visit the Court. Before leaving Chhattisgarh, the petitioner will inform the local police station about the case and the date and the period for which he is going to stay in Bihar to attend the cases.
12. Let a copy of this order be communicated to the Superintendent of Police, Bilaspur through FAX for its compliance forthwith.
