2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 409, 420 and 34 of the Indian Penal Code .

3 . As per the prosecution case , this petitioner along with other co-accused persons embezzled sum of RS. 2,68,535 /- in the construction of Panchayat Bhawan .

4. Learned counsel for the petitioner submits that petitioner innocent and has committed no offence as alleged. Petitioner was the Panchayat Secretary of Nayagaon Gram Panchayat, Block Sultanganj Bhagalpur and has no concern and connection with the construction of Panchayat Bhawan and the petitioner is only formal member in joint account along with

Patna High Court CR. MISC. No.354 of 2025(2) dt.31-01-2025 2/2 Mukhiya as the entire construction work was in his hands. He further submits that co-accused Rahul Kumar who was Mukhiya of the aforesaid Panchayat has already deposited the alleged money in compliance to the order passed by this Hon'ble court in Cr. Misc. No. 48967 of 2024 vide order dated 18.09.2024 . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts, clean antecedent of the petitioner and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Bhagalpur in connection with Bath P.S. case No. 82 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
