2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code .

3 . Prosecution case , in brief, is that on 08.04.2024 at about 8 AM, daughter of the informant went for nature's call but did not return. Informant alleged that all the F.I.R. named accused persons, including this petitioner, kidnapped her daughter for the purpose of marriage .

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence . Petitioner is husband of the victim and has falsely been implicated in this case . As a matter of fact, victim in her statement recorded under

Patna High Court CR. MISC. No.88189 of 2025(2) dt.10-02-2026 2/2 Section 183 BNSS has denied the factum of kidnapping and categorically stated that she on her own will had gone with this petitioner to Delhi and solemnized marriage with him. Petitioner claims clean antecedent.

5 . Learned A.P.P. for the State vehemently opposed the bail application .

Considering the aforesaid facts, statement of the victim recorded under Section 183 BNSS and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate , Gaya in connection with Belaganj P. S. Case No. 207 of 2024 , subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 .
