NILU AGRAWAL ORAL ORDER 07-01-2019 Heard the learned counsel for the petitioner and the learned counsel appearing for the Union of India. No notice is required to be issued to opposite party no. 1, Indrasan Devi, the wife of employee, late Awadh Narayan Singh, in view of the order which is to be passed today. Petitioner has preferred a review application for review of the order, dated 21.05.2015, passed in C.W.J.C. No. 6064 of 2014, stating therein that a writ application against the Norther Coal Fields Limited, Jayant Project, Sighrauli, Madhya Pradesh, is not maintainable as the employee, late Awadh Narayan Singh, was all along posted in the Northern Coal Fields Limited, Jayant Project, Sighrauli, Madhya Pradesh, till his
Patna High Court C. REV. No.84 of 2018(3) dt.07-01-2019 2/2 retirement.
Considering the fact that this Court in the writ application filed by opposite party no. 1, Indrasan Devi, the mother of the erstwhile employee, claiming death-cum-retiral benefit has not been decided on merit, but, the disputing parties the wife, Raj Kumari Singh, Sister Durgawati Kumari and the petitioner, had been given liberty to approach the Court of competent civil jurisdiction and beget a succession certificate for their entitlement as being successor of late Awadh Narayan Singh, this review application is of an academic nature.
