The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2588C/2016 in which cognizance has been taken under Sections 420 and 406 of the Indian Penal Code. The petitioner is alleged to have sold a land belonging to opposite party no. 2/complainant knowing fully well that the land did not belong to him. Learned counsel appearing for the petitioner has submitted that if at all some portion of the land of opposite party no. 2 has been sold, that because of some confusion over the measurement of the land.
Patna High Court Cr.Misc. No.57128 of 2018(3) dt.10-12-2018 2/2 In any view of the matter, considering the case to be of a civil nature/dispute, this Court is inclined to grant anticipatory bail to the petitioner.
The petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Araria in connection with Complaint Case No. 2588C of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
