The petitioner seeks bail in Bihar P.S. Case No. 47 of 2018 instituted for the offence under Sections 392 and 412 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 23.2.2018. He has clean antecedent. He is not named in the written report. The name of petitioner has come during investigation on the basis of Test Identification Parade in which the informant is alleged to have identified as a person who was standing in front of the vehicle (Tanker) and stopped it. Counsel for the petitioner has filed copy of Test Identification Parade as Annexure-4 from which it appears that he was not identified as a person of committing any offence.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif, in connection with Bihar P.S.
