2. The petitioner seeks bail in connection with NCB Case No. 07 of 2024 instituted for the offence under Sections 8(c), 20(b) (ii)(c), 25, and 29 of the NDPS Act.

3. The prosecution story, in short, is that upon secret information the NCB team intercepted one truck bearing reg No. WB23E4246. On query the driver disclosed his name as Manoj Sharma and another person who was sitting by the side of the driver disclosed his name as Ankit Shukla and on enquiry both persons accepted that in a secret box Ganja is concealed. From the said secret box of the truck a total of 622 kg Ganja was recovered and on confessional statement of Ankit Shukla name of the petitioner has transpired.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1043 of 2025(7) dt.01-07-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case merely on confessional statement of apprehended coaccused Ankit Shukla. Learned counsel has further submitted that he has been implicated due to oblique and ulterior motive as the petitioner was not in the said truck nor seizure list was prepared in his presence and the said truck does not belong to the petitioner and he is not aware about the persons arrested and seized Ganja. Learned counsel has next submitted that the investigation was over and there is no chance of tampering with the investigation, by the petitioner. It has lastly been submitted by learned counsel for the petitioner that the petitioner has antecedent of one criminal case which is of similar nature and has been in judicial custody since 13.05.2024.

Learned Senior SC for the N.C.B., vehemently opposed the prayer for bail of the petitioner and has submitted that the involvement of the petitioner in the present case has appeared during the course of investigation through the call details obtained by the Investigating Officer from which it appeared that it was the petitioner who arranged the co-accused namely Ankit Shukla as per the direction of main receiver namely Ashok Kushwaha @ Bablu. Call details also reveal that

Patna High Court CR. MISC. No.1043 of 2025(7) dt.01-07-2025 3/3 more than 52 calls were exchanged between the culprit found in possession of contraband and this petitioner. The allegation, as such, is quite serious.

Considering the aforesaid facts and circumstances of the case and taking into account that huge quantity of Ganja was recovered and that the petitioner has antecedent of one criminal case of similar nature, I am not inclined to enlarge the petitioner on bail.
