The petitioner seeks bail in connection with Mairwa P.S. Case No. 241 of 2019, registered under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of nine cartons, each containing 48 bottles (180 ml each), 62 bottles, each containing 750 ml and 200 bottles, each containing 180 ml Indian made foreign liquor recovered from the tempo which was being driven by the petitioner.

Submission is that petitioner is simply the driver of the seized auto, which was belonging to Raja and on his instruction, the petitioner was carrying the seized bottles for unloading at Chapra. The petitioner has no criminal antecedent and is in custody since 06.09.2019.
