2. The petitioner has preferred this application for grant of regular bail in connection with Khagaul P.S. Case No. 5117042240220 i.e. 220 of 2024 dated 13.07.2024 registered for the offences punishable u/ss 103(1), 61(2) read with 3(5) of the B.N.S.

3. As per the prosecution case, on 12.07.2024, in the evening, the informant along with the barat party came at Rudra Marriage Hall situated at Khagaul Road, Danapur. During the course of marriage ceremony, some altercation took place between the co-accused, Vicky Kumar Yadav and Shubham Singh with Golden Kumar Singh and Sharvendra Kumar. After some time, the accused persons namely, Vicky and Shubham came at the gate of the aforesaid marriage hall and started open fire. Having heard the sound of firing, the informant along with Golden and Sharvendra came out then the co-accused, Vicky Kumar Yadav and Shubham Singh and their friends started firing indiscriminately due to which Golden Kumar Singh and Sharvendra Singh sustained gunshot injury and they died on the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Vicky Kumar. There is no specific allegation against the petitioner rather the specific allegation is against the coaccused, Vicky Kumar Yadav and Shubham Singh who are the main assailants in this case. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.09.2024.

5. Learned A.P.P. for the State has vehemently

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur in connection with Khagaul P.S. Case No. 5117042240220 i.e. 220 of 2024.
