Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is not named in the FIR whereas some others are named in the FIR of the occurrence of murder. Name of the petitioner surfaced in the confessional statement of coaccused. Petitioner has stated on oath that he has got no criminal antecedent.
Learned counsel for the informant opposed the prayer for bail on the ground that the telephonic conversation with the petitioner and another co-accused would reveal that the petitioner was involved in the conspiracy of murder. Considering the fact that there is no direct and

No.81872 of 2019(2) dt.18-12-2019 2/2 substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Buxar (M) Police Station Case No. 186 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
