JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-05-2018 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned A.P.P. The petitioner apprehends his arrest in Nautan P.S. case No. 522 of 2017 for the offences punishable under Section 366A/34 of the Indian Penal Code.
The informant alleged that her daughter had gone to attend the call of nature but the petitioner along with other accused persons kidnapped her daughter for the purpose of marriage. The learned counsel for the petitioner submits that the victim returned and made her statement under Section 164 of the Cr. P. C. The victim disclosed her age to be 18 years. She disclosed that she voluntarily left her house and went to
Patna High Court Cr.Misc. No.26094 of 2018 (2) dt.04-05-2018 2/2 Chandigarh along with petitioner and solemnized marriage in a temple.
The learned A.P.P. as well as the learned counsel for the informant vehemently opposed the prayer for anticipatory bail. Having regard to the facts that victim herself denied the factum of her kidnapping, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bettiah, in connection with Nautan P.S. case No. 522 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
