In this case, the petitioner is apprehending his arrest in connection with Sour Bazar (Police Camp Pastpar) P.S. Case No. 459 of 2017 (POCSO Case No. 37 of 2017) registered for offences under sections 363, 366(A), 376, 34 of the Indian Penal Code and Section 4 of the POCSO Act.

In the present case, an allegation has been made that the petitioner and his associate forcibly took away the minor daughter of the Informant and ravaged her modesty which she has narrated.

Looking to the entire facts and circumstances of the case and the nature of offence, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Patna High Court Cr.Misc. No.26788 of 2018(2) dt.03-05-2018 2/2 Accordingly, the prayer for anticipatory bail of the petitioner, namely, Md. Laddu is rejected.

The petitioner must surrender before the court below within a period of four weeks from today, in failure to do so, the Superintendent of Police, Saharsa, is directed to arrest the petitioner and bring him to the court.
