JUSTICE RAKESH KUMAR ORAL ORDER 08-05-2018 Heard Sri Hari Kishore Thakur, learned counsel for the petitioner and Sri Ajay Kumar Jha, learned A.P.P. The sole petitioner, who is in custody since 6.2.2018 in connection with Excise Case No. 23 of 2018, P.R. Case No. 27 of 2017-18, registered for the offence under Section 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
Learned counsel for the petitioner submits that on false accusation as if petitioner was driver of the Bolero, the practitioner was apprehended and it was shown that huge quantity of Indian make foreign liquor was recovered from the said Bolero. It was argued that petitioner was having no connection with the Bolero, neither petitioner was owner of the
Patna High Court Cr.Misc. No.27903 of 2018(2) dt.08-05-2018 2/2 Bolero nor he was having any association with the said Bolero but he has falsely been implicated in the present case. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph no. 3 of the petition to show that petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner: Vijay Kumar Das be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur / concerned court in connection with Excise Case No. 23 of 2018, P.R. Case No. 27 of 2017-18. (Rakesh Kumar, J) praful/- U T
