1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Harnaut P.S. Case no.716 of 2023 registered under sections 395 and 397 of the Indian Penal Code.

3. As per the prosecution case, the informant states that six accused persons on two motorcycles on the point of country made pistol looted the informant of Rs.57,000/, a mobile phone and also assaulted him with the butt of a pistol. The accused persons were aged between 20-30 years.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case in course of investigation when his name was allegedly taken by a spy. No incriminating article has been recovered

Patna High Court CR. MISC. No.929 of 2025(3) dt.09-04-2025 2/2 from his possession. The only material against him is the confessional statement. The petitioner who is in custody since 8.8.2024 has not been put on T.I. parade.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the name of the petitioner transpiring in course of investigation, no incriminating article having been recovered from his possession, inspite of being in custody since 8.8.2024 the petitioner not having been put on T.I. parade and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Harnaut P.S. Case no.716 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, POCSO, Biharsharif, Nalanda.
